Silvers comments to a group of Associated Press Sports Editors came hours before Atlantas Jeff Teague tossed in a wild 3-pointer as he dribbled left with the shot clock winding down and the Hawks leading Indiana by six. When officials later reviewed the shot to see if Teague was behind the arc, it was clear he had first stepped out of bounds before shooting. As Indiana players screamed for the basket to be overturned, referee Tony Brothers explained that it couldnt be. The Golden State Warriors hung on for a 109-105 victory over the Los Angeles Clippers in Game 1 of their series after a similar replay issue. When officials went to the monitor to review a ball out of bounds with 18.9 seconds left and Golden State leading by two, they could see that the Warriors Draymond Green had first fouled Chris Paul. However, because that wasnt reviewable, all they could rule was the ball had gone off of Paul. Silver said its confusing for viewers to see something obvious on replay, yet the officials appear to have "blinders" on and do nothing about it. "I think the most difficult area now, even for our fans to understand, is when an official can go to replay and everyone can see something that looks like a foul or wasnt a foul, but yet the official is restricted from being able to apply, in essence, his judgment on the play," Silver said. "And I think thats an area that I think inevitably were going to reach, where an official is going to need to have some more discretion." But senior vice-president of basketball operations Kiki VanDeWeghe said its a bit of a "slippery slope" in determining how far officials can look backward before the play they are reviewing. "Those are things that when you start to have subjective calls and youre looking at a lot of things, and youre giving more discretion on what to look at, those are the problems and the issues that you try to figure out," VanDeWeghe said. "But like Adam said, giving the referees a little bit more discretion when theres something obvious that happens within the context of the foul, you want to get it right." Clippers coach Doc Rivers, a member of the leagues competition committee, said the committee talked about it last year. They apparently had the same concerns as VanDeWeghe. "Its a hard one. It really is," Rivers said. "We all want them to get everything right. But how far does that go when you start doing that? How far do you go on that? Did he step on the line? Well, maybe he fouled him. But there was a travel down there. Look, there. At some point, is it just on the ball? Is it off the ball? It can go a long way. Orpik suffered a concussion and was taken to hospital. The Appeal Process As a first step, Thornton will appeal the suspension to Commissioner Gary Bettman. He hears all appeals on league discipline. Since the suspension exceeds five games, Bettman is required to have an in-person hearing for Thornton. Since Thornton was at the NHL office last week for his disciplinary hearing, he should know his way around by now. The Collective Bargaining Agreement (CBA) provides that "the Commissioner shall endeavor to hear all appeals on an expedited basis and will determine whether the decision" is supported by clear and convincing  evidence. So Bettman will get this done quickly and will assess whether the suspension makes sense based on the circumstances. Thornton should expect to fail on appeal to Bettman. The suspension was handed down by the Director of Player Safety Brendan Shanahan. However, given the complex legal implications of this case, particularly in light of the concussion lawsuits, the suspension was very likely a group effort. So the suspension wasnt a Shanahan decision as much as it was a league decision issued through Shanahan. As a result, its unlikely Bettman will reduce the suspension. Frankly, reductions by Bettman are unlikely in most circumstances. He runs the league so he wont contradict himself. Indeed, the NHLPA has probably told Thornton the prospects of success are bleak. And this brings us to the next stage in the appeal process. Appeal Number 2 It doesnt end with Bettman. Since the suspension exceeds five games, the CBA gives Thornton the right to appeal Bettmans decision to an independent arbitrator. This wasnt around in the old CBA and is brand new, thanks to the NHLPAs negotiations during the lockout. Thornton will have seven days to appeal Bettmans decision to the arbitrator (who is described as a "Neutral Discipline Arbitrator" in the CBA). There will once again be an in-person hearing, and while the CBA doesnt say when it must occur, the arbitrator needss to hear it on an "expedited basis".cheapjerseyswholesalenfl.us/. . So again, relatively quickly. The arbitrator will consider the length of the suspension and whether its appropriate. That determination will be made by examining things like the incident, the leagues past practice, the evidence and the surrounding circumstances. The arbitrator has broad powers. The CBA gives the arbitrator "full remedial authority", which means he can reduce the suspension, leave it as is, or even increase it. Its unlikely, though, the suspension would ever be increased. If Thornton is unhappy with the decision of the arbitrator, his only recourse would be to challenge the ruling in court. However, a judge will not interfere with the arbitrators decision unless its completely outrageous. Effectively, then, you should consider the arbitrators decision final. To be clear, Thornton doesnt have to appeal Bettmans ruling to the arbitrator. If he wants, after the Commissioner rules on his case, he can decide to stop the appeal process and serve out what is left of his suspension.  As I wrote here, Thorntons prospects of success on appeal are low, given the NHLs past practice when it comes to these types of incidents. As well, the NHL may be able to make a compelling case that this type of suspension represents an important deterrent for on-ice behaviour that puts players at risk for concussions and the irreversible brain damage that may flow from head shots. However, merits aside, I also noted that we could still see an appeal. Since independent arbitrators are new, the NHLPA may want to start building precedents to help guide them in future cases. As well, the NHLPA needs to show that it wont roll over when it comes to defending its players and that it is prepared to dig in and fight. So while this case does not present a high likelihood of success for Thornton, the NHLPA sees value in taking a stand. And as it should. As for Brooks Orpik, he may not be too happy with the NHLPA defending his attacker. Still, the NHLPA may draw the fine distinction that the appeal is not adverse to Orpik, but rather adverse to the NHL and its decision. So the Union isnt technically acting against one of its own, but instead acting on behalf of one of its own. That is a distinction that may not sit well with Orpik. However, thats the nature of the NHLPA beast. ' ' '

The Broncos spent the first day of free agency bolstering their defensive backfield, agreeing to a four-year deal with Pro Bowl safety T.J. Ward on Tuesday afternoon and then hours later reaching an agreement on a six-year contract with cornerback Aqib Talib. Talib and Ward will play in a secondary that will be without Champ Bailey, who was released last week, and may be moving on from Rodgers-Cromartie, who entered free agency without a new deal from the Broncos. The 28-year-old Talib had quite a year for New England last season, with teams largely choosing to go the other way rather than pick on him. Sound familiar? There are a number of reasons that the Kings sweep of the Blues would be considered unlikely and not only because it is the first time that a No. 8 seed has beaten both a No. 1 and a No. 2 seed in the same playoff year (let alone dispatching of them in a total of nine games) to advance to the third round. The Kings also managed to make short work of St. Louis despite being held to 62 shots over the last three games. Certainly, there are score effects involved (teams that establish early leads are likely to shoot less once the lead is established), but 62 shots over three games is remarkably few.
